Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of MowGuard (the “Service”), operated by First Penguin Apps (“we”, “us”, “our”), a company registered in Sweden. By connecting your Jobber account to the Service or subscribing to a plan, you agree to these Terms on behalf of the business you represent (“you”, “your business”). The Service is intended for business use only and is not directed at consumers.

2. The Service

MowGuard lets lawn care contractors accept skip requests from their customers online instead of by phone or text. The Service connects to your Jobber account via Jobber's official API, sends your customers a permanent, unique link to a self-service request page, collects skip requests for their next visit, and — once you approve a request — deletes the corresponding visit in Jobber on your behalf. Where a fee applies, the Service can create a separate Jobber invoice for that fee; actual collection happens either through your customer's self-service payment in Jobber Client Hub or through a manual charge you make in Jobber, since Jobber does not provide a way to automatically charge a saved card.

The Service is an independent product. It is not created, endorsed, or operated by Jobber Software Inc. “Jobber” is a trademark of its respective owner.

3. Accounts and access

Access requires a valid Jobber account connection authorized by an administrator of your Jobber account. You are responsible for maintaining the security of the devices and browsers used to access the Service. You may disconnect the Service from your Jobber account at any time from Jobber's App Marketplace.

4. Subscriptions, trials, and billing

The Service is offered as a monthly subscription in three plans (Solo, Growth, and Established), each including all product features and differing by the number of customers with an email address on file and an active skip-enabled recurring job (up to ~40 for Solo, ~100 for Growth, and unlimited for Established). Every plan starts with a 14-day free trial. A valid payment method is required to start a trial; you will not be charged until the trial ends, and you can cancel at any time before the trial ends at no cost. If your usage exceeds your plan's customer limit, we will not block the Service; instead, your dashboard will show a warning and an option to upgrade.

Payments are processed by Stripe. We do not store your card details on our servers. Subscriptions renew automatically each month until cancelled. You can cancel, change plans, or update your payment method at any time via the “Manage subscription” page; cancellation takes effect at the end of the current billing period, and you retain access until then. Fees already paid are non-refundable except where required by law.

If a renewal payment fails, Stripe will retry the charge for a limited period during which your access continues. If all retries fail, your subscription is cancelled automatically and access is suspended until you subscribe again.

We may change subscription prices with at least 30 days' notice; changes apply from your next billing period after the notice.

5. Acceptable use

You agree not to:

  • use the Service in violation of applicable law;
  • attempt to gain unauthorized access to the Service, other customers' data, or underlying systems;
  • resell, sublicense, or provide the Service to third parties outside your business without our written consent;
  • interfere with or disrupt the integrity or performance of the Service, including by circumventing usage limits.

6. Your data

You retain all rights to the data you submit to the Service or that is imported from your Jobber account, including your account settings and the fee, billing, and job configuration you provide (“Business Data”). You grant us the rights needed to host and process Business Data solely to provide the Service. Our processing of personal data is described in the Privacy Policy. After you disconnect the Service from Jobber, Business Data is retained for 30 days (to allow reconnection) and then deleted.

7. Your customers' data

To provide the skip-request feature, the Service processes personal data about your customers — the property owners you serve — that Jobber makes available to us, including their email address, service address, and skip-request history (“Customer Data”). As between you and us, you are the data controller and MowGuard acts only as your data processor with respect to Customer Data: we process it solely to operate the Service on your instructions (as described in these Terms and configured in your account settings), and not for our own purposes. You are responsible for having a lawful basis to collect and share your customers' personal data with us and for meeting your own obligations to your customers under applicable data protection law (including the GDPR, where it applies to you). Our commitments as your processor — including confidentiality, security measures, sub-processors, and handling of data subject requests — are set out in the Privacy Policy, which forms part of these Terms.

8. Intellectual property

The Service, including its software, design, and branding, is owned by First Penguin Apps and protected by applicable intellectual-property laws. These Terms do not grant you any rights to the Service other than the limited right to use it in accordance with these Terms.

9. Third-party services

The Service depends on third-party services, including Jobber (data source, visit deletion, and invoicing), Stripe (subscription payments), and Brevo (delivery of reminder and notification emails to your customers). We are not responsible for the availability or performance of third-party services, and features that depend on them may be limited by those services.

10. Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. The Service is a request-handling and fee-calculation aid only: you remain solely responsible for reviewing and approving skip requests, for confirming any fee amount before it is invoiced, and for the collection of any fee, since Jobber does not offer a way for us to automatically charge a saved card — payment depends on your customer's self-service payment or a manual charge you make yourself. We do not warrant that information displayed by the Service is complete or error-free.

11. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, revenue, or data, arising from your use of the Service. Our total aggregate liability under these Terms is limited to the amounts you paid for the Service during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory applicable law.

12. Termination

You may stop using the Service at any time by cancelling your subscription and/or disconnecting from Jobber. We may suspend or terminate access for material breach of these Terms with reasonable notice where practicable. Sections that by their nature should survive termination (including 6, 7, 8, 10, 11, and 14) survive.

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will provide notice (for example, in the app or by email) at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to its conflict-of-law rules. Disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Swedish courts, with the district court of the seat of First Penguin Apps as the court of first instance.
